Iliad Preparing to Challenge 5G Spectrum Extension - Report

Iliad Italia is prepared to challenge the country’s communications regulator Agcom if it finally grants a 6-year extension to licences owned by WiMax providers including Linkem, Tiscali, Go Internet, Mandarin and TIM to use 5G-capable frequencies in the 3.4-3.6 GHz range, reports Corriere delle Comunicazioni. French-owned Iliad is one of the five operators that last month spent a total of EUR 6.55 billion to acquire spectrum in the in 694-790MHz, 26.5-27.5GHz and 3.6-3.8GHz bands and is ready to file a complaint at the Regional Administrative Court of Lazio, the main Italian administrative court of first instance, if Agcom approves the extension to licences owned by WiMax providers.

The news comes after the same source reported that senators from the Five Star Movement (M5S) have already asked industry minister Luigi Di Maio to probe the licence renewals on grounds that they are “totally unjustified” and “discriminatory towards the remaining players in the market” after they shelled out more than EUR 4 billion for spectrum in the 3.7 GHz band alone in last month’s 5G auction.

The legal challenge to the licence renewals could also threaten Fastweb’s EUR 150 million dealto acquire 40 MHz of spectrum in the 3.5 GHz band from Tiscali as well as its Fixed Wireless Access (FWA) division, added the report.
